Bankruptcy and Insolvency Law: Recent SCC Judgments

Professor Wood cited in two recent Supreme Court of Canada decisions.

15 November 2015

Professor Rod Wood's Bankruptcy and Insolvency Law, Irwin Law (2009) was extensively cited in two recent Supreme Court of Canada decisions. Both decisions dealt with the doctrine of federal paramountcy.

In Alberta (Attorney General) v Moloney, 2015 SCC 51, the Court held that a provision in the Traffic Safety Act that allowed the suspension of a driver's licence of a driver who failed to pay compensation in respect of an uninsured car accident frustrated the fresh start policy of bankruptcy law. In Saskatchewan (Attorney General) v Lemare Lake Logging Ltd, 2015 SCC 53, the Court held that Saskatchewan farm protection legislation did not conflict with the national receivership provisions in the Bankruptcy and Insolvency Act.

Professor Wood has been busily working on the second edition of the book, which will be released near the end of this year.
